These Terms and Conditions (the “Terms”) govern your access to and use of thinkdigita.com (the “Website”) and your purchase or use of any digital product, software access, licence, subscription, setup service, or related service offered through the Website (collectively, the “Products”).

The Website is operated by Think Digita, a sole proprietorship based in Mirpur, Dhaka 1216, Bangladesh (“Think Digita”, “we”, “us”, or “our”). You can contact us at support@thinkdigita.com.

By accessing the Website, creating an account, placing an order, or using a Product, you agree to these Terms. If you do not agree, do not use the Website or purchase a Product.

1. Eligibility and customer information

You must be legally capable of entering into a binding contract in your jurisdiction. If you purchase on behalf of a company or another person, you confirm that you have authority to bind them to these Terms.

You must provide accurate, current, and complete information during checkout and keep your account and contact information updated. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.

2. Products and product-specific terms

Think Digita offers digital products and services that may include software licences, subscription or account-based access, downloads, activation or setup assistance, updates, and related support. The exact Product, access period, device or site limits, renewal terms, delivery method, included support, and other conditions are stated on the relevant product page or checkout page and form part of these Terms.

Some Products are supplied, licensed, hosted, or operated by third parties. Your use of such a Product may also be subject to the applicable publisher’s, developer’s, or service provider’s end-user licence agreement, acceptable-use policy, privacy policy, or other terms. If a third-party term conflicts with a Product description on our Website, contact us before purchase.

Product names, logos, trademarks, and brand names belong to their respective owners. Their appearance on the Website identifies compatible or supplied products and does not by itself imply endorsement, partnership, or affiliation unless we expressly state otherwise.

3. Licence and permitted use

Unless a product page expressly states otherwise, your purchase gives you a limited, non-exclusive, non-transferable, revocable right to use the Product for your own lawful personal or internal business purposes during the stated access period. No ownership of software, source code, trademarks, copyright, or other intellectual property is transferred to you.

You must not:

  • resell, sublicense, distribute, share, rent, or commercially exploit a Product or access credential unless the product page expressly permits it;
  • circumvent activation, access, security, usage, device, domain, or licence restrictions;
  • reverse engineer, decompile, modify, copy, or create derivative works except where applicable law or the relevant third-party licence expressly permits it;
  • use a Product for unlawful, fraudulent, abusive, infringing, or harmful activity;
  • provide false information, misuse another person’s payment method, or attempt an unauthorized chargeback; or
  • interfere with the Website, checkout, delivery systems, or another customer’s access.

4. Orders and acceptance

An order is an offer to purchase. We may accept or reject an order, request additional verification, limit quantities, or cancel an order where reasonably necessary, including for suspected fraud, pricing or technical errors, Product unavailability, sanctions or legal compliance, or a violation of these Terms.

An automated order confirmation only confirms receipt of your order. A binding purchase is formed when payment is successfully authorized and we or our payment provider confirm acceptance or begin delivery, whichever occurs first.

5. Prices, taxes, and payment

Prices and currencies are shown at checkout. Unless stated otherwise, applicable taxes may be included in the displayed price or calculated at checkout according to your location and the payment provider’s tax rules.

For checkouts powered by Paddle, the Paddle entity identified during checkout acts as the merchant of record and authorized reseller for the transaction. Paddle processes payment, calculates and collects applicable sales taxes, and issues payment documentation under its applicable buyer terms and privacy notice. The descriptor on your bank or card statement may refer to Paddle.

For other payment methods, payment may be processed by the provider shown at checkout. You authorize the applicable provider to charge the total amount displayed. We do not guarantee that every payment method will be available in every country or for every Product.

6. Delivery and activation

Digital Products are generally delivered electronically through your Website account, email, download link, licence key, account invitation, activation, or assisted setup. The expected delivery time shown on the Website is an estimate. Where no different time is stated, delivery normally occurs within 10 minutes to 6 hours after successful payment and any required verification.

Delivery may be delayed if information is incomplete, an email address is incorrect, payment is under review, third-party provisioning is unavailable, or additional verification is reasonably required. You must check your spam or junk folder and contact support@thinkdigita.com if delivery is not received within the stated period.

You are responsible for confirming before purchase that your device, website, hosting, operating system, software version, region, and other technical environment meet the Product requirements. Setup or activation assistance does not include unrelated development, customization, migration, or troubleshooting unless expressly included in the product description.

7. Subscriptions, access periods, and renewal

A Product may provide one-time access, access for a stated fixed period, or a recurring subscription. The applicable model is displayed on the product and checkout pages.

If a purchase is recurring, the billing amount and frequency will be shown before payment. By subscribing, you authorize recurring charges until cancellation. You may cancel through the method stated in your order confirmation, the customer portal (where available), or by contacting support. Cancellation stops future renewal charges but does not normally create a refund for an already-started billing period, except where required by law or permitted by our Refund Policy.

Fixed-period access ends when the stated period expires unless it is renewed. Updates, support, cloud features, or vendor services may stop when access expires even if a locally installed version continues to function.

8. Refunds and cancellations

Refund eligibility is governed by our Refund Policy, which forms part of these Terms. Because Products are digital and may be delivered, activated, downloaded, or provisioned immediately, refund rights may be limited after delivery or use, subject always to mandatory consumer law.

Before filing a payment dispute or chargeback, please contact support@thinkdigita.com so we can investigate and attempt to resolve the issue. Nothing in these Terms prevents you from exercising rights that cannot legally be waived.

9. Support, updates, and changes

Support scope and duration are stated on the relevant product page. Support does not cover issues caused by unsupported environments, third-party conflicts, customer modifications, credential sharing, misuse, malware, hosting failures, or failure to follow instructions.

Third-party publishers may update, modify, discontinue, restrict, rename, or replace their products or features. Where this materially affects an undelivered order, we may offer a reasonable substitute, wait for restoration, or provide a refund where appropriate. We do not control third-party product roadmaps or service availability.

10. Intellectual property

The Website’s original content, layout, graphics, branding, text, and software are owned by or licensed to Think Digita and are protected by applicable intellectual-property laws. Except for the limited right to use the Website and purchased Products under these Terms, no rights are granted to you.

If you believe content on the Website infringes your rights, email support@thinkdigita.com with sufficient details for us to investigate.

11. Privacy and communications

Our handling of personal information is described in our Privacy Policy. Payment providers and third-party Product providers may process information under their own privacy notices.

You agree that we may send transactional communications necessary to process your order, deliver Products, provide security notices, and respond to support requests. Marketing communications will be sent only as permitted by applicable law, and you may unsubscribe from them.

12. Availability and disclaimers

We aim to describe Products accurately and keep the Website available, but we do not guarantee uninterrupted, error-free, or universally compatible operation. Images, screenshots, colours, feature lists, delivery estimates, and availability may change or contain minor inaccuracies.

To the maximum extent permitted by law, the Website and Products are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability, except for warranties that cannot legally be excluded. We do not guarantee any particular business, revenue, ranking, traffic, security, or performance outcome.

13. Limitation of liability

To the maximum extent permitted by applicable law, Think Digita and its owner, personnel, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profits, revenue, data, goodwill, business opportunity, or use arising from the Website or a Product.

To the maximum extent permitted by law, our total aggregate liability relating to a specific claim will not exceed the amount you paid to us for the Product giving rise to that claim during the 12 months before the event giving rise to liability. These limits do not apply where liability cannot legally be limited, including liability for fraud or wilful misconduct.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Think Digita from third-party claims, losses, and reasonable costs arising from your unlawful use of the Website or a Product, your infringement of another person’s rights, your breach of these Terms, or your misuse or unauthorized distribution of a Product.

15. Suspension and termination

We may suspend or terminate access where reasonably necessary to prevent fraud, security harm, illegal activity, infringement, unauthorized sharing or resale, non-payment, chargeback abuse, or a material breach of these Terms. Where appropriate, we will provide notice and an opportunity to remedy the issue. Termination does not affect rights and obligations that arose before termination.

16. Governing law and disputes

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles. Before starting formal proceedings, both parties should attempt in good faith to resolve the dispute by contacting the other party and allowing a reasonable time for a response.

Subject to any mandatory consumer rights or jurisdictional rules that apply to you, the courts of Dhaka, Bangladesh will have exclusive jurisdiction over disputes arising from these Terms, the Website, or a Product.

17. Changes to these Terms

We may update these Terms to reflect changes in our Products, payment arrangements, legal obligations, or business practices. The revised version will be posted on this page with an updated date. Changes apply prospectively unless applicable law requires otherwise. Your continued use of the Website after the effective date constitutes acceptance of the revised Terms.

18. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a restructuring, transfer, or sale of our business, subject to applicable law.

These Terms, the applicable product description, our Refund Policy, and our Privacy Policy constitute the agreement between you and Think Digita concerning the relevant purchase, together with any mandatory terms presented by the applicable payment provider.
